All services provided by Neweb Ireland may be used for lawful purposes only. Transmission or storage of any information, data or material in violation of any Irish law is prohibited.
NOTE: Pornography and sex-related merchandising or service is prohibited on any services provided by Neweb Ireland. Neweb Ireland and the relevant hosting service will be the sole arbiter as to what constitutes a violation of this provision.
Acceptance of domain names is the sole responsibility of the registration body associated with the required name. As agents for Internet services, NEWEB Ireland accepts no responsibility for decisions made by such bodies when considering registration.
The Irish Domain Registration body requires that all applications for .ie registration must be accompanied with all relevant documentation as listed in the IEDR terms and conditions.
Copyright of all work carried out by NEWEB Ireland remain the sole property of NEWEB Ireland until all payments have been made in full by the said client. Illegal or unauthorized reproduction, distribution or use of material, or any portion if it, without prior written consent may result in legal prosecution.
Billing for all work carried out by NEWEB Ireland will occur on a thirty-day basis or on completion of each phase of contract, whichever comes first. Once a contract price has been agreed, clients will be invoiced for a deposit payment. Billing dates will begin from receipt of deposit payment.
The first payment of contract constitutes acceptance of terms, unless prior terms have been agreed in writing.
If a client leaves Neweb Ireland for any reason all payments and credits will be null and void. pre-pay credit is non-refundable.
In the event of a change of site after the agreed price, all amendments will be reflected in the next billing period. Should a change occur after the final payment, subsequent invoices will be issued to take in these changes.
As and from January 2002 all invoices that exceed specified due dates will incur credit charges at a rate of 10.25%. This policy is in line with the commercial payments protection act 1997 and EU Directive 2000/35/EC Final document.
Neweb Ireland reserve the right to suspend all service if invoices issued exceed thirty days. This includes but is not limited to Domain and Hosting including Email. Services provided by Neweb Ireland will only be restored when all late payments have been paid in full.
Third Party Payments:
Third party services must be paid in advance of any establishment of services unless prior terms have been agreed in writing. NEWEB Ireland reserve the right to suspended, without prior notice, services if payment has not reached us by billing due date. Domain name renewals will only be paid on receipt of payment from the client.
Quotations by NEWEB Ireland will be valid for a maximum period of 60 days only. In the event of contracts in progress, each phase of billing will comply with the 60-day validation terms commencing from the agreed start date of each phase.
All contracts that exceed the maximum validation period will be re-priced from the phase that exceeded the 60-day validation terms.
Responsibility for supply of site content will lie with the person or company that the site is being developed for. Information for site content must be supplied within reasonable time for each phase of the site to be completed prior to established completion dates as set out in agreement contracts. Failure to provide content within maximum validation period (see price validation, section 1) will result in revaluation of contract for each phase beyond specified validation period.
The client will be liable for any legal action resulting from the publication of information, data or material in violation of any Irish law or defamation of character to persons or companies directly or indirectly related to the client. This includes, but is not limited to: copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Neweb Ireland from any claims resulting from the use of the service, which damages the subscriber or any other parties.
Search listings will occur on a monthly basis with a maximum listing period of six months. NEWEB Ireland is not responsible for search engine positioning. Once a site is listed, it is the sole discretion of the search engine companies to place your listing on their servers.
Regional listing on larger search engines will be considered a single unit when volume listings are required.
All accounts that exceed their allocated limits will incur a charge for each Mb over there limit. This charge will be billed on a monthly basses until such a time as the account drops below its allocated limits.
